Position Summary: Under the direction of the Deputy Counsel of Due Process, with wide latitude for independent action, the Senior Advisor will work to develop frameworks for docketing enhanced rate equitable services requests under the New York State Education Department (NYSED)’s regulatory mandate for the provision of those services. The Senior Advisor will engage with the Deputy and Executive General Counsels, Impartial Hearing Office and the Special Education Unit of the Office of the General Counsel, the Special Education Office primarily with its policy team and the Committees on Special Education, parents, their representative and non-public schools to ensure the collection of enhanced rate equitable services requests and supporting documentation. The Senior Advisor will work with the Special Education Office on improving existing websites, New York City Public Schools (NYCPS) notices, and other communications about the provision of equitable services and the process for requesting enhanced rates of equitable services. The position will work with the Enhanced Rate Equitable Services Request Unit staff to develop data collection and analysis tools to track information about enhanced rate equitable services requests. Performs related work.
Reports to: Deputy Counsel of Due Process
Direct Reports: Agency Attorneys, Enhanced Rate Equitable Services Request Services Unit.
Key Relationships: Will work closely with NYSED’s P-12 Education Office Due Process Unit, the NYCPS Office of The General Counsel (OGC) – Special Education Case Management (SECM) leadership, Impartial Hearing Office (IHO) and Special Education Unit (SEU), and the NYCPS Special Education Office – Policy Team and Committees on Special Education (CSEs). Will also work with ERESRU legal coordinators, parents, parent representatives and advocacy groups.
Responsibilities
• Assist with creating a process for the docketing of enhanced rate equitable services requests filed under New York State Education Law § 3602-c.
• Develop training materials and conduct training regarding the docketing of enhanced rate equitable services requests.
• Maintain knowledge of current Federal and NYS regulations on enhanced rate equitable services requests.
• Analyze issues raised in requests, and case law to identify trends in terms of enhanced rate equitable services requests.
• Review existing administrative processes and update office guides regarding enhanced rate equitable services requests to update the office's reference materials.
• Review existing regulations and procedures, propose legislation changes with supporting authority regarding enhanced rate equitable services requests, and provide policy guidance to the Deputy Counsel, Executive Deputy Counsel, and General Counsel regarding the impact on the Unit and the NYCPS.
• Ensure that time-sensitive matters are handled promptly.
• Perform legal research.
• Review existing regulations and procedures, propose legislation changes with supporting authority, and provide advice regarding the impact on the office and the NYCPS.
• Work with attorneys and other members of the ERESRU management team, provide training to other NYCPS offices and units.
• Act as a liaison with executives within the NYCPS and other City agencies.
• Assist in the overall supervision of the office, including filling in for other legal staff in emergency situations.
Qualification Requirements:
Minimum
Admission to the New York State Bar AND three (3) years of progressively responsible United States legal experience subsequent to admission to any state bar.
NOTE: Selected candidates must remain members of the New York State Bar in good standing for the duration of their employment.
Preferred
• Knowledge of IDEA, New York State Education Law § 3602, New York State Regulations of the Commissioner, and the New York City Department of Education Chancellor’s Regulations.
• Knowledge of case docketing procedures.
• Experience training staff.
Salary: $118,800 - $123,300
(Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
