A law firm in New York City, NY, seeks a highly motivated and experienced Mid-Level Advertising and Marketing Compliance & Litigation Associate Attorney. The ideal candidate will provide legal counsel to diverse clients, ranging from entrepreneurial start-ups to major brands and international retailers. This role demands a deep understanding of advertising and marketing laws and substantial litigation experience, particularly in federal and state regulations.
Key Responsibilities:
• Provide comprehensive legal counseling on various advertising and marketing practices.
• Review and evaluate advertising copy to ensure compliance with legal standards.
• Counsel clients on sweepstakes, promotions, and compliance with relevant rules and regulations.
• Represent clients in investigations and litigation involving advertising and marketing practices.
• Handle cases before the Federal Trade Commission (FTC), state consumer protection agencies, and the National Advertising Division (NAD).
• Manage consumer class actions, including case preparation, discovery, and trial.
• Advise on compliance with FTC rules and regulations, pricing laws, telemarketing laws and regulations, autorenewal laws, advertising agreements, and email marketing laws.
• Draft and negotiate advertising-related agreements.
• Stay current with evolving advertising and marketing laws and trends to provide proactive legal advice.
• Collaborate with other attorneys and legal professionals to deliver comprehensive legal services to clients.
Requirements:
• 2-5 years of experience in advertising and marketing compliance and litigation.
• Proven experience practicing before the FTC, state consumer protection agencies, and the NAD and handling consumer class actions.
• In-depth knowledge of advertising laws, including FTC rules, pricing laws, telemarketing regulations, autorenewal laws, and email marketing laws.
• Strong background in advertising copy review, sweepstakes and promotions counseling, and legal compliance.
• Excellent oral and written communication skills.
• Outstanding academic credentials.
Education:
• Juris Doctorate (JD) degree from an accredited law school.
Certifications and Licenses:
• Must be admitted to and in good standing with the New York State Bar.
