Job Duties: Estate Senior Attorney
As a Senior Estate Attorney at our law firm, you will be a seasoned legal professional responsible for handling a diverse range of complex cases, including estate planning, estate administration and estate litigation. Your role will involve legal strategy development, case management, client representation, and mentoring junior attorneys.
Case Strategy and Management:
• Develop comprehensive case strategies for estate planning, estate administration and estate litigation.
• Analyze legal issues, conduct legal research, and provide guidance to junior attorneys on case development.
• Collaborate with clients to define legal objectives and align case strategies with their goals.
• Manage Junior Attorneys and Staff
• Direct Litigation
Client Representation
• Represent clients in court proceedings, hearings, motions, depositions, and trials.
• Prepare and present persuasive legal arguments to achieve favorable outcomes for clients.
• Collaborate with clients to provide regular updates on case progress and developments.
Legal Research and Analysis
• Conduct in-depth legal research on complex issues.
• Analyze case law, statutes, and regulations to support legal arguments and strategies.
• Draft legal memoranda, pleadings, motions, and other case-related documents.
Estate Planning
• Develop sophisticated estate plans tailored to individual clients' needs, including wills, trusts, powers of attorney, and healthcare directives.
• Provide strategic advice on estate planning, asset protection, charitable giving, and business succession planning.
• Collaborate with clients to achieve their wealth preservation and distribution goals.
Estate Administration
• Oversee and guide the administration of complex estates, including probate, asset distribution, and trust administration.
• Provide legal counsel on tax implications, fiduciary duties, and beneficiary disputes.
• Ensure compliance with legal requirements and deadlines throughout the estate administration process.
Estate Litigation
• Manage and lead estate litigation matters, including will contests, fiduciary disputes, and contested guardianships.
• Develop legal strategies, conduct legal research, and prepare persuasive arguments.
• Represent clients in court proceedings, hearings, and negotiations.
Case Documentation and Management
• Prepare, review, and manage legal documents, including pleadings, discovery requests, and court filings.
• Maintain accurate and organized case files and records using case management software.
• Ensure compliance with court deadlines and requirements.
• Attend all necessary court hearings
Negotiation and Settlement
• Negotiate settlements and resolutions with opposing parties, when appropriate.
• Collaborate with clients to assess settlement offers and provide strategic advice on negotiation outcomes.
Mentorship and Collaboration
• Provide guidance and mentorship to junior attorneys, paralegals, and legal staff.
• Collaborate with colleagues on legal strategies, case development, and team initiatives.
• Foster a collaborative and supportive work environment within the Estate team.
Client Development and Business Generation
• Cultivate and maintain client relationships, including identifying cross-selling opportunities.
• Participate in business development efforts, networking events, and client pitches to attract new clients.
• Contribute to the growth and reputation of the firm's Estate practice.
Requirements:
• Juris Doctor (J.D.) degree from an accredited law school and admission to the state bar.
• Proven track record of successfully managing complex Estate matters.
• Excellent litigation, negotiation, and courtroom skills.
• Strong legal research and writing abilities.
• Proficiency in using legal research tools, case management software, and Microsoft Office Suite.
• Excellent communication, interpersonal, and leadership skills.
• Strong organizational and multitasking abilities.
• Commitment to providing exceptional legal services and achieving favorable outcomes for clients.
